Terms of Engagement
Project Consultation: Initial consultations are provided to understand your requirements, budget, and timeline. Detailed project proposals will be provided based on these discussions.
Contracts and Agreements: All projects require a signed agreement outlining scope of work, timelines, payment terms, and deliverables before commencement.
Design Process: Our design process follows our Dream-Design-Deliver methodology, ensuring clear communication and quality execution throughout the project lifecycle.
Payment Terms
Fee Structure: Our fees are project-based and depend on scope, complexity, and square footage. Detailed fee structures will be outlined in individual project agreements.
Payment Schedule: Projects typically follow a milestone-based payment schedule:
- 30% advance payment upon agreement signing
- 40% upon design approval and material selection
- 30% upon project completion and handover
Additional Costs: Client is responsible for all material costs, contractor charges, government approvals, and any changes to the original scope of work.
Client Responsibilities
Access and Information: Clients must provide timely access to project sites and accurate information about space dimensions, structural limitations, and requirements.
Decision Making: Clients are expected to make timely decisions on design concepts, material selections, and project modifications to maintain project timelines.
Payments: All payments must be made according to the agreed schedule to ensure uninterrupted project progress.
Intellectual Property
Design Ownership: All design concepts, drawings, and 3D visualizations remain the intellectual property of Arc Heaven Studio until final payment is completed.
Usage Rights: Upon full payment, clients receive usage rights for the specific project. Designs cannot be replicated for other projects without separate agreement.
Portfolio Usage: Arc Heaven Studio reserves the right to use project photographs and designs for marketing and portfolio purposes unless otherwise agreed.
Project Timeline and Delivery
Timeline Estimates: Project timelines are estimates based on scope and complexity. Actual completion may vary due to material availability, approvals, or unforeseen circumstances.
Force Majeure: We are not liable for delays caused by natural disasters, government regulations, material shortages, or other circumstances beyond our control.
Project Changes: Any changes to the original scope of work may affect timeline and cost, which will be communicated and agreed upon before implementation.
Quality and Warranties
Design Quality: We ensure that all designs meet professional standards and are suitable for their intended purpose.
Material Warranties: Material warranties are provided by respective manufacturers. Arc Heaven Studio facilitates warranty claims but is not directly responsible for product defects.
Workmanship: We work with trusted contractors and provide supervision to ensure quality execution. Workmanship warranties are provided as per contractor agreements.
Limitations of Liability
Service Limitations: Our liability is limited to the total value of design fees paid for the specific project.
Third-Party Services: We are not liable for delays or issues caused by contractors, suppliers, or government agencies.
Design Suitability: Clients are responsible for ensuring that final designs meet their specific needs and local building codes.
Termination
Client Termination: Clients may terminate services with 15 days written notice. Payment for work completed up to termination date will be required.
Studio Termination: We reserve the right to terminate projects for non-payment, safety concerns, or breach of contract terms.
Post-Termination: Upon termination, all design materials remain the property of Arc Heaven Studio unless full payment has been completed.
Dispute Resolution
Mediation: Any disputes will first be addressed through direct discussion and mediation.
Jurisdiction: These terms are governed by Indian law, and any legal proceedings will be conducted in the courts of Delhi.
Professional Standards: We adhere to professional design standards and ethical practices in all our engagements.
